Summary/Abstract: The current international context, emphasized by the disappearance of internal borders, highlights the danger of crime, especially the organized crime, as well as the difficulties encountered by the judicial authorities in responding efficiently to the expectations of citizens and the needs of states in a secure manner, shows how the introduction of the European arrest warrant has marked a turning point in the construction of Europe and especially in the creation of a European criminal justice area. The European Arrest Warrant was established by Framework Decision no. 2002/584 /JHA of the Council of the European Union of 13 June 2002 of which the exact title was the Decision on the European arrest warrant and surrender procedures between the Member States of the European Union and entered into force on 7 August 2002. Thus, this paper highlights issues related to the functionality of the European arrest warrant in terms of national regulation on the issuing of the European Arrest Warrant by Romanian courts with applicability in judicial practice.
