Summary/Abstract: This recommendation is about legal regulatory framework of fundamental rights involved in the re-use of public sector information and about the method of implementation of these rights in secondary EU law. It is particularly focused on subsidiarity and proportionality of EU law and the ways in which the differences in understanding of mutual balance of fundamental rights with regards to PSI re-use on the level of EU, CoE and in Member States, affect the efficiency of the Directive.
