Summary/Abstract: The paper presents a prosecutor’s trial position in administrative proceedings and the rights that allow to distinguish him/her from other subjects acting as parties. The purpose of the prosecutor’s participation in the administrative proceedings is to remove the unlawful state and ensure that the proceedings and the settlement are lawful. The role of the prosecutor does not limit his/her function to criminal proceedings only, but it activates him/her in other types of proceedings, where it is required by the public interest.
