IMPLEMENTATION OF THE AGREEMENT ON THE SUCCESSION OF THE FORMER SFRY

Summary/Abstract: This paper includes a review of the most important provisions of the Agreement on succession of former Yugoslavia, which was, after the signing in Vienna on 29th June 2001, ratified by Bosnia and Herzegovina, among the first successors. This paper provides an overview of the implementation of the General Agreement and all its annexes and appendixes, chronologically over the last decade. The author specifically mentions the importance of unblocking the negotiations on particular issues, changes or adoption of internal laws of the successor to the correct and effective implementation of the Agreement. New procedures and regulations, as well as mechanisms for effective implementation, with the normative and the need to change unacceptable practices of domestic judicial, administrative and other bodies of some successor states to the executive point of view, will be particularly necessary for implementing the Agreement in all its parts. The author believes that the actual results and effective implementation of the Agreement and the rights of many people damaged by past war depend on these circumstances.
