The concept of sanitary and epidemiological safety and its legal contexts

Summary/Abstract: This paper deals with the issue of sanitary-epidemiological safety as a dogmatic concept. The notion of sanitary-epidemiological safety is not a commonly used term. In the doctrine, it is referred to when discussing the issues of state security or health security. Certain features of this category of safety are pointed out in the system of internal security of the state. Extremely important, from the point of view of public administration bodies’ activity, is the separation of this category within the general security. A specialized body such as the State Sanitary Inspectorate operates in strictly defined situations of threat to sanitary security and in the area of antiepidemic policy. Pointing to the functioning of such a body within the framework of universal security is too far-reaching a generalization, therefore it will be justified to try to separate the notion of sanitary and epidemiological safety from the adopted system of internal security of the state. The considerations will be of the dogmatic and legal character and will be supported by rich literature on the subject and legislative examples.
