Summary/Abstract: The damage caused by the loss of an opportunity to obtain an advantage, should be treated as a separate category of what is commonly the concept of injury and this may originate both in the way it is generated as well as in the rules for compensation for damage. It was recognized not only in view of the economic rights, but also of the personality rights brought under discussion in connection with medical liability in respect of the health risks and the need to inform the patient.
