Summary/Abstract: Democracy, the rule of law and human rights are interconnected both in structure as well as in substance. Modern and postmodern times have seen disconcerting developments that indicate the fact that human rights have become a sine qua non condition for the reconfiguration of a state governed by the rule of law. The mutations and moments of crisis that have accompanied the global process of “democratization” have also drawn our attention to the necessity that calls for a state governed by the rule of law to become the guarantor and protector of human rights. These rights must not be just solemn or rhetorical declarations but must ensure the legitimacy of the state’s internal policies, as well as a humanitarian approach to international relations.
