Summary/Abstract: The Decree of the President of Romania establishing or prolonging the state of siege or the state of emergency constitutes an administrative act, subordinated to the law. It is not a decree-law, so it does not represent an act of primary regulation, the President of Romania not being a legislator even in exceptional situations. The adoption of legislative measures through such decrees is unconstitutional.
