Summary/Abstract: It is well known that human rights underpin constitutionalism and the primary purpose of any constitution would guarantee freedom and security is human in all respects. The main tool that defends and promotes human rights and fundamental freedoms in our country is the Constitution revised in 2003, but there are laws like the Civil Code, which in their content of human rights safeguards in the Constitution, as is right private property. Exercise of human rights directly interact with legal rules contained in the Romanian Civil Code, and bringing it an important contribution to ensuring one of the fundamental human rights, namely property rights.
