Summary/Abstract: The European Data Protection Board has adopted on 19 March 2020 the Statement on the processing of personal data in the context of the COVID 19 outbreak. It provided the possibility for the governments of the Member States to use personal data related to the mobile phones of individuals, to monitor and mitigate the spread of COVID 19. However, the unlimited and arbitrary use of personal data of individuals is not allowed; only the use of those data that are relevant for the purpose for which they were collected. The applicability of the principle of proportionality should not be forgotten in this situation, as less invasive solutions of privacy are preferred. Analyzing the experience of countries such as South Korea and Israel, we find that localization technologies can only work where they are accepted by the population and are not perceived as an illegal sanction or surveillance. Romania should take transparent measures that guarantee access to justice and at the same time to devise a clear regulation regarding the data that will be used, the authorities that could use them and the purpose in which they are collected. All this only if the restriction on the rights of individuals would necessarily be imposed and the efficiency in the fight against Covid 19 would be proven.
