Summary/Abstract: In the course of history, freedom of religion and belief has denied for a long time. Quite often the political power turned religion into a partner to prevent the assertion and the achievement of human rights. Had the spirit of tolerance and understanding always been able to impose itself, history wouldn’t have been marked by numerous religious wars. A permanently hot topic for the history of mankind, freedom of religion and belief can not be approached by the international public law apart from a good knowledge of the evolution of the notion of “religious freedom” in the constitutional texts. Freedom of religion and belief, as a fundamental right, is consecrated by texts of conventions and, therefore, from a legal point of view, opposable to the States that ratified them. Its consecration by national constitutional texts strengthens even more its value as a legal norm, as a principle of the international law. Nevertheless, what is really important is that States Should effectively consecrate and guarantee it in their national legislations.
