Summary/Abstract: The right to freedom of conscience, religion and belief confirms the spiritual dimension of the human being. At present, the issue of freedom in general, and religious freedom in particular, and, in close relation to it, the issue of moral responsibility, has got particular importance. The author deals with the topic of religious freedom in light of the constitutional provisions and the jurisprudence of the Constitutional Court of Romania. Following several juridical clarifications related to the right to have one's own beliefs, the right to express one's own beliefs, the public order clause and the conscientious objection, he presents a number of constitutional provisions alongside the interpretations the Constitutional Court has made by means of its decisions. Freedom of religion and the general regime of the cults are presently regulated by Law No. 489/28.12.2006, while the activities of the cults are performed in accordance with their religious education and the Statute adopted in conformity with the domestic legislation.
