Some considerations relating to the juridic regem of special pensions and indemnizations for age limit in Romania

Summary/Abstract: Special pensions and old-age allowances are neither “senseless” nor “irreversible social anomalies”. They have the legal nature of social security rights granted to certain categories of insured persons, by organic laws, as compensation of risks and increased prohibitions compared to policyholders in the public pension system. They are granted to socio-professional categories subjected to a special status, persons who, by virtue of their profession, occupation or qualification, form a professional career in that field of activity and are obliged to submit to the requirements inherent in their professional career, both professionally and personally. In view of the specific situation of certain socio-professional categories, the legislature may establish legal treatments differentiated both by conditions and criteria for granting derogations and by a different method of calculation and amount of pensions.
