Summary/Abstract: The approach to the topic involves comparative law studies, with implications upon the social-economic and political realities and their historical evolution, while highlighting the causal relations of each stage in the development of society. A researcher interested in the century-old history of our people may decipher certain elements that could be attributed to a Romanian “prehistory” of human rights. The documents dating as far back as the Phanariot rulers aimed at establishing institutions, which paved the way for the changes to come, institutions reflecting the latest developments of the Romanian society. For instance, the Scarlat Calimach's Code included an important element: “all people shall consider themselves entitled to rights”. This “all people” actually means acknowledgement of an essential principle: all are equal before the law.
