Summary/Abstract: The article deals with medical confidentiality in French law. It describes its roots and current legal form based on the provisions of the French Penal Code and the Public Health Code. The article, referring to the current legal regulations and jurisprudence, characterizes the subjective and subjective scope of medical secrecy by analyzing in detail the entities obliged to keep it and its content. The text lists exceptions to the obligation of medical secrecy and attempts to characterize the concept of “common medical secrecy”. Part of the study is also devoted to the doctor’s relations with third parties and medical secrecy after the patient’s death.
