Summary/Abstract: The article presents a critical analysis of a jurisprudential solution on how to resolve the request for clarification of the operative part of a judgment rendered in the matter of labor disputes. The arguments put forward argue for the clarification of the device taking into account, on the one hand, the generic content of the provisions of art.80 of the Labor Code, taken in the operative part of the court decision, and on the other hand, the divergences in relation to the legislative novelties regarding the staff remuneration and the modification of the collective labor contract at company level.
