Summary/Abstract: While referring to the fundamental social rights, the author points out several topical issues. The most important one in his opinion is that the protection of these rights is still insufficient, first of all in comparison to the expectations of their holders, while it is tributary to an obsolete historical context, according to which the world was divided into antagonist political-military blocks. Another problem comes from the differences in terminology and concepts when approaching the social exclusion phenomenon as well as the configuration of the fundamental right to minimal living conditions. Unification of the regulation and protection of the two categories of rights – civil and political and economic, social and cultural – is more topical than ever, but it depends on the political will of States.
