Summary/Abstract: Conditional release is a material-legal institute because it modifies the prison sentence. Also a conditional release is a penal institute whose application avoids the harmful effects of long-term imprisonment and criminal infection, and the convict is encouraged to behave well and participate in the process of re-socialization. In modern criminal law, parole is widely accepted and belongs to those institutes that have a long tradition in normative and practical life. As a penological and criminal-political measure by which additional individualization of the sanction is performed, it stimulates the convicted person to behave well and to be actively involved in the process of its execution. The application of parole has recently sought to address the problems of overcrowding in prisons, but also the reduced stay of such persons in institutions due to the well-known shortcomings of institutional sanctions. In this paper, in accordance with the allowed space, we will briefly analyze all the positive and negative sides of the conditional release, the conditions for its application, the competent authorities authorized to grant conditional release, the issue of supervision over conditionally discharged persons and revocation of conditional release. , and will also offer certain suggestions de lege ferenda.
