Summary/Abstract: This article describes the line of conflict between the legal systems generated by contemporary societies and artistic practice. When activities in the field of art collide with applicable law, there is a discussion as to which values are more important in this dispute. One of the elements of resolving this conflict is the idea of the countertype of art. The author points to Caroline Levine’s concept, which argues the incompleteness of the view that art needs support in a democratic society in order to function. According to Levine, for its healthy development, modern democracy needs art that expresses the contestation and defense of minority views. The author puts forward the thesis that a society that marginalizes art, soon becomes marginalized by a power that cannot bear criticism.
