INACCURATE NOTES REGARDING THE TERM OF EXERCISE OF THE ROUTE OF ATTACK. CIVIL PROCEDURAL CONSEQUENCES

Summary/Abstract: The civil procedure code from 1865 and the new one, adopted by Law no.134 / 2010, condition the exercise of remedies by comply with the conditions provided by law in terms of their type, the conditions and terms of introduction. However, the new Civil Procedure Code gives the possibility to remedy the irregularities caused by wrong indication in the device of the decision of appeal, the duration of exercise period or the moment from which it begins to run. This new regulation is particularly useful as not all parties benefit from legal assistance during civil proceedings and, most of the time, not having in-depth knowledge of law to allow them to detect the error of the judge, presumed to be an absolute knowledge of law.
