Summary/Abstract: The public procurement process should be a tool through which (among other things) the procurement of goods and services from public sources takes place in the most efficient and transparent way possible. There are a number of ways in which this objective can be prevented, but these should be detected and sanctioned by the competent supervisory authority. One of the possibilities through which the conditions of the public tender are distorted is the area of contractual terms and conditions, the examination of which by the competent authority supervising in the field of public procurement is (usually) limited. In order to examine these limits in the Czech‑Slovak area, the authors of the article focus on the analysis and comparison of the scope of supervision in the field of setting discriminatory contractual terms and conditions in the Slovak Republic’s and the Czech Republic’s surroundings.
