Criminal policy and the model of court probation

Summary/Abstract: The author analyzes the relationship between criminal policy and court probation model in a historical perspective. The basic thesis presented in the article is that the assumptions under- lying the model of court probation differ from contemporary repressive criminal policy. The lack of consistency leads to functional and axiological threats. Hope for a change in this situation should be seen in the crisis of penal populism and related legal changes, especially in the USA.
