A fragile construction. A critical look at the current regulation of the agency contract

Summary/Abstract: Not always new rules mark the progress of the regulated institution. Taken out of the realm of the special law and assimilated under the cupola of the unitary private law, the agency contract has also received a new definition that rises identity issues and which is different from the corresponding regulations of EU and international law. This paper ais to examine the juridical nature, the particulars and some effects of the agency contract, as regulated by the Civil Code, attempting to unravel, by way of legal interpretation, the logical construction of this contract.
