Summary/Abstract: Custody is the rights and duties given to parents for the protection and representation of children, which constitute the future of society. The concept of custody has been formed for the protection of the child both within the marriage and when the marriage ends. The best interest of the child is what is essential in custody. In this respect, the interests of the child should be taken into account in the custody regulations instead of the wishes of the mother and father. One of the measures to be taken for the protection of the child is the change of custody. In accordance with the Turkish Civil Code numbered 4721, the custodian can be changed when the interests of the child require.
