FORMS OF THE RESPONSIBILITY OF THE HEAD OF THE STATE

Summary/Abstract: Thematic in this article is the argument that provisions in the constitutive instrument establishing different forms of responsibility of the Head of state which makes irrelevant the fact of official capacity as Head of state. Without more, the immunities of Heads of states under customary law could not prevent and release the Head of the sate from his responsibility. This thesis will undertake analysis of the elements and structure of the responsibility of the Head of the State, considering the perspective of the development the nature of the responsibility as constitutive instrument and substantive part in any form of government.Thematic in this article is the argument that provisions in the constitutive instrument establishing different forms of responsibility of the Head of state which makes irrelevant the fact of official capacity as Head of state.
