Summary/Abstract: This article treats the termination of the employment contract by the employer with notice on the base of Art. 328, para. 1, p. 4 LC – lack of capacity of the employee for efficient execution of the work. The article presents the legal character of this reason for termination of the employment contract as well as the legal characteristic of its elements as a legal fact. Issues related to the applicability of this reason depending on the ground for establishment of the individual employment relationship and on the different phases of development and performance of this relationship are put under discussion. Finally, the place of this reason in the system of grounds for termination of employment contracts under the legal regulation in force and the doctrinal positions on this issue are analysed.
