Summary/Abstract: The article examines the origin and the content of the discriminatory motive as a separate type of criminal motive. The approaches of Bulgarian legislation in defining the discriminatory motive and the related grounds of discrimination are analyzed. The discriminatory motive is differentiated from motives stemming out from personal relations and hooligan intent. The applicability of each of the three types of motives is discussed and borderline cases are outlined. A differentiation between discriminatory motives based on different grounds is also provided. The relevant judicial practice and the trends of its development are reviewed in detail. Certain proposals de lege ferenda are made as well.
