Once Again about the Covenant of Possession (In reply to Professor Vladimir Petrov)

Summary/Abstract: The article considers some specific issues regarding the disposition of possession and the covenant of possession in particular. The arguments against the admissibility of the covenant of possession are examined and an appeal for a more open interpretative approach towards this legal phenomenon is made. The Inheritance Act does not deny the possibility to carry out a covenant of possession and in the legal practice there are certain interests in recognizing such a legal figure. The covenant of possession has triggered a discussion which can enrich the legal doctrine and broaden the conceptual perspectives of jurists.
