The Exchange Contract form another Point of View

Summary/Abstract: The legal notion of exchange needs a separate study within the Bulgarian law doctrine. This article only outlines the major issues that are to find their interpretations. The first part of the article provides a brief review of the Bulgarian legal literature dedicated to the exchange contract, while explaining the lack of special research interest to this topic. Reasons are stated that could raise interest to the specifics of the exchange contract. The second part of the article is provoked by some studies of the exchange in a wider context, focusing on its nature as an economic relation. The final part of the article approaches the various conceptual views on the exchange as a Roman private law contract, and traces from a historical perspective its classification under the group of the unnamed contracts, as well as its gradual transition to the consensual contracts.
