Is the Covenant of Possession Possible and Admissible under the Inheritance Act?

Summary/Abstract: The article submits to critical analysis the view – published in a popular-science juridical journal – according to which the Inheritance Act allows and regulates the possibility of establishing a covenant of possession separately from the item of property upon which the said possession is exercised. Numerous arguments are brought for proving that the establishment of such a covenant of possession is an absurdity from a theoretical point of view and that the legislation disallows the existence of such a figure in law.
