Summary/Abstract: Nowadays people constantly search for more effective protection of human rights and more cost-effective methods of dispute resolution. The steadily increasing number of court cases, on the one hand, demonstrates the high availability of justice and, on the other hand, the declining ability of people to live in harmony with each other and resolve their conflicts in independent and amical way. Mediation is one of the ways of avoiding the state interference into interpersonal relationships and of ensuring the self – determination of parties to resolve their dispute. However, global trends and their reflections in Lithuania show that mediation is increasingly being used as a means of solving the heavy workload of courts and reducing the cost of dispute resolution for countries and the state. This takes us away from the basic idea of mediation, which is to enable the disputing parties to make their own decisions by collaborating, to encourage them to be responsible for making and enforcing the decision, and to acquire more conflict management skills. The article aims to reveal the purpose of the mediation process and to determine the preconditions for the proper application of this method of conflict resolution in Lithuania.
