Home Office – Distance Working according to the Conditions of § 317 of the Labour Code

Summary/Abstract: The article deals with the issue of performing dependent work according to the conditions of § 317 of the Labour Code which is most often referred to as home office. Because such a designation is not used by law, this article deals with the comparison of the terms that are used for this legal institute and determines the basic criteria for its precise definition. In the following sections, the article deals with the issue of the place of performing dependent work as a basic feature of this institute, and describes and analyzes the limits of its legal adjustment. It focuses on the issue of OHS, accidents at work, remuneration and other situations which are possible limitations in application in practice.
