MIXED MARRIAGES IN THE MUSLIM DIASPORA ACCORDING TO YŪSUF AL-QARAḌĀWĪʼS FIQH

Summary/Abstract: This article examines the question of mixed marriages in the fiqh of Muslim minorities and in the related sharīʻa and legal regulations, as well as certain reflections and practical problems that arise with such marriages. The article pays particular attention to the views of Yūsuf al-Qaraḍāwī, an eminent contemporary scholar who has studied and published on the issue of Muslims living in diaspora, i.e. in the West. Al-Qaraḍāwī is chairman of the European Council for Fatwa and Research. As its name suggests, the Council deals with the question of Muslims living in Europe, given how many Muslims emigrated to West European countries during the final decades of the 20th century, becoming citizens and facing specific challenges in living Islam and cultivating Islamic values. In this regard, it is instructive to compare the views of the Islamic community in Bosnia and Herzegovina on mixed marriages with those of al-Qaraḍāwī, and the European Council for Fatwa and Research. This treatment may also serve as an example of how to answer the questions of the independence of the fiqh of the Muslim diaspora, as a separate legal discipline of Islamic law, and of its scope.
