Legal Regulation of the Obligation for Payment of Insurance Premiums under the Insurance Code

Summary/Abstract: The article deals with some of the most important issues related to the insurance premiums under the Insurance Code. In compliance with the insurance contract the insurant is obliged to pay the insurer the respective premium. Under the Code this is the first obligation in chronological terms deriving from the insurance contract, unless otherwise contracted. In cases of temporary insurance coverage contracted the insurer has to pay the insurance compensation even when the insurance event had occurred during the period in which the insurant had not been obliged to pay the premium. The author analyses the obliged parties, the way of determination of the insurance premiums, the specifics of the regulation regarding the extended payment of the premium and the consequences of its non-payment. Some critical remarks in view of the current legal regime are made due to the fact that in the field under review the regulation does not always defend the interests of the insurants.
