Summary/Abstract: The voluntary withdrawal from participation in a criminal enterprise follows a special legal regime under a system of provisions of the Special Part of the Criminal Code. Being a withdrawal from a concluded continuing formal offence, it is an exclusion from the general rule that all crime withdrawals must be realised before the offence has been finished. The withdrawal from participation in a criminal enterprise is characterised by general and specific features depending on whether they are required by all provisions regulating withdrawal, or by some of them. The general ones include concurrency in the subject of the withdrawal and the offence, delivery of comprehensive information about the criminal enterprise to the authorities, and voluntary and final decision of the subject to withdraw. The specific features of the institute concern only the objective. They include surrender of the subject to the authorities, cessation of the participation in the criminal enterprise, legal indications of the type of criminal enterprise and its criminal activities.
