Summary/Abstract: The author deals with the right to fair trial indicated in Article 46 paragraph 1 of the Constitution of the Slovak Republic. She is analysing the content of the Article 46 paragraph 1 of the Constitution with the help of judgements of the Constitutional court of the Slovak Republic. She's trying to show the right to fair trial on the decisions of the Slovak courts – the Constitutional court of the Slovak republic and the Supreme Court of the Slovak Republic.
