Summary/Abstract: In accordance with the code procedure for the removal of a parish priest, the diocesan bishop must take advice of the group of parish priests. There are different opinions about necessity of this consultative group. Only some members of this group take part in giving his advice to the matter which was presented by the bishop. The group of parish priests is a collective body. The diocesan bishop is not obliged to accept their opinion, nonetheless he cannot act contrary to it, unless he is sure of reasons for the removal of the parish priest from his office. In such a case, he may cause the illicit of the legal act, consequently he will be obliged to repair the damage inflicted which arose as a result of issuing such a legal act. The stage of seeking the opinion of two parish priests is one of the guarantees of maintaining the principle of impartiality and equal treatment of the party.
