Problems Regarding Liability for not Making Investments under Privatization Contracts

Summary/Abstract: The article treats problems that occur in the process of claiming liability of the transferees under privatization contracts by reason of not making the investments they had promised. The legal content of the obligation for making certain investments and the rights of the parties to the contract deriving from non-fulfillment of this obligation are examined. The author’s opinion is that in this case there is a contract for the benefit of third parties and if the promisor does not perform his duties, the beneficiary obtains the right to claim implementation, the right to contract out and the right to claim compensation for the damages suffered due to non-feasance.
