Unsolicited Electronic Communications

Summary/Abstract: The article treats the coordination of Bulgarian law with the European legal framework regarding unsolicited electronic communications. A brief review of the two regimes — opt-in and opt-out, is made. The opt-in mechanism, established in the Directive on electronic commerce (2000/31/EC) is compared to the opt-out resolution in the Directive on privacy and electronic communications (2002/58/EC). The Bulgarian draft on electronic commerce which was proposed recently is evaluated in relation to unsolicited electronic communications.
