Reinstatement of an Illegally Dismissed Employee in Civil Service

Summary/Abstract: The subject matter concerning the reinstatement of an illegally dismissed employee in civil service is of considerable practical importance for it refers directly to the realization of the civil servant’s rights under the official legal relation. Some problems occur when applying the law, and they derive from the differences in the conceptions about the legal effects of the reversal acts of dismissal orders. Therefore the necessity of their examination is obvious. Bearing in mind that the reinstatement in civil service is closely related to the right to defense exercised by the employee against the illegal dismissal, the legal nature of the unilateral termination of the official legal relation by the administrative body is generally clarified in this research. The problems are interpreted in the context of the normative regulation regarding the reinstatement of an illegally dismissed civil servant in civil service.
