Human Rights in the Context of Fighting International Terrorism: Aspects from International Law Viewpoint

Summary/Abstract: The article focuses on the legal framework for response to international terrorism in conformity with the international human rights standards. It offers an analysis of the UN actions taken after 11 September 2001, in particular the adoption of Res. 1373 by the Security Council. The authors note that the link between the fight against terrorism and the respect for human rights has not been ignored by the Security Council ant its subsidiary bodies. The derogation of certain human rights under the International Covenant on Civil and Political Rights is also explored through the prism of the need for a proper balance between respect for human rights and anti-terrorist action. States and the international community as whole should counter international terrorism with all means provided by the international law. The measures against terrorism, however, should be based on the appropriate balance between the protection of national security and well being, on the one hand, and the civil and political rights, on the other.
