Summary/Abstract: European and international legislation, judicial guidelines and case law should be, if not one of the cornerstones of the national legal vision in the medical malpractice field, at least, recommendations in this regard. Their usefulness is due to years of legal analysis and judicial practice in the field of medical malpractice, which Romania has only recently faced, being easy to see that medical malpractice is an unexplored field, insufficiently analyzed and regulated by outdated legislation. Although the amplitude of international materials allows only a brief review of the important cases, we want the following material to be a starting point in the legal research on medical malpractice.
