Landmarks regarding the appreciation of the adverse interest in the matter of the protection of the minor in the civil law

Summary/Abstract: We evaluate as only righteous the lawmaker’s hesitance to assign the definition of „adverse interest” trend with regard to the protection of the individual, as the subjective reasons, in concreto, are decisive in the process of qualifying a situation as part of the adverse interest lexical legal field. Taking all these aspects into account, the aim of the present paper is to review some indicators that are valuable in analysing particular situations.
