Constitutional Conformity and Legislative Expediency of the Amendment Act to the International Trade Arbitrage Law of 24 April 2002

Summary/Abstract: This article is provoked by the unfounded attack of the Supreme Cassation Court on the last amendments to the International Trade Arbitrage Law - State Gazette, issue 46 of 2002. In the article are summarised the arguments of the Constitutional Court on the compliance of the new regulation of the revocation of arbitrage decisions with the Constitution of the Republic of Bulgaria. There are also some additional considerations pointed out. A more important task the authors set themselves, is to emphasise the positive consequences, which followed the radical change in the body competent to pass judgement on the revocation of arbitrage decisions for the national as well as for the international trade arbitrage, performed in Bulgaria.
