Summary/Abstract: This article presents the legal and ethical implications of the therapeutic privilege. The therapeutic privilege, although not legally regulated, is recognized by both the literature and the specialized practice, implying important legal consequences that will be analysed in the following. The therapeutic privilege has been recognized by the courts as an exception to the obligation of disclosure incumbent the doctor. However, it is necessary to determine whether and when it is legal and ethical not to disclose medical information.
