Summary/Abstract: The report examines in general terms the characteristics of the physical evidences and the preconditions for their return during the pre-trial phase. The compliance of the law with the standards of the ECtHR for a coercive measure (what the retention and ongoing storage of physical evidence represent) and the actions of the national law enforcement authorities are examined.
