Summary/Abstract: The conclusion of a contract may be preceded by negotiations between future parties to the contract, which must be carried out in accordance with good faith requirements. In case one of the negotiating partners breaches good faith requirements, the other negotiating partner is entitled to obtain damages on the basis of civil liability, in which case the applicable liability and the quantification of damages must be determined.
