Bankruptcy

Summary/Abstract: The article considers the crime of bankruptcy. The signs of corpus delicti are analysed from both objective and subjective side. Comparative law characteristic if the problem is made, examining legislative decisions in Germany, Austria and Switzerland. The normative basis and court practice on this matter, considering the old Penal Code /1896/, are viewed at length. On the basis of the conclusions the made in this article suggestions about future changes in the Penal code are given, aiming better effectiveness.
