Summary/Abstract: The article addresses the controversial issue of Greek origin of the emphyteusis in the Roman law. The author builds her thesis on the grounds of etymology analysis of the concept, and of the analogical of the emphyteusis long-term leases in the ancient Greece during the period of V—III c. b. c. as well. She admits that the emphyteusis is a Roman law institute, which synthesizes the land practice in the Mediterranean, but is not directly apprehended by the Greek land relations. The reglamentation of the land relations by the civil and provincial law is used in its establishment, and the name is introduced because of the figurativeness of the terminology, and in relation with the concerned land practice application, mainly in the eastern parts of the Roman Empire.
