Summary/Abstract: In Romania, economic operators can provide funeral services – firstly – if they meet the criteria provided by the 'Law no. 102 from 8 July 2014 on cemeteries, human crematoriums and funeral services', and by the 'Technical and Health Rules regarding the funeral services, burial, cremation, transport, exhumation and reburial of human corpses, cemeteries, human crematoriums, and also the professional criteria that must be met by the providers of funeral services and the level of the guarantee fund' approved by Government Decision no. 741 of 12 October 2016, and – secondly – if they obtain the approval of the local council of the administrative-territorial unit in which they carry out their activity. Essentially a funeral service provider should refrain from providing such services in the absence of (a) the sanitary authorization for the provision of funeral services which attests the compliance with hygiene and public health norms, on the one hand, and (b) the approval of the local council, on the other hand. However most funeral parlors offer 'complete funeral services' despite not fulfilling one or even both mentioned conditions. That is why this brief study aims to analyze the extent to which the rules enacted for consumer protection oblige funeral service providers to disclose whether or not they hold the two authorizations. A conclusion is that the Romanian legislator should improve the national legal framework by regulating the obligation on funeral service providers to inform consumers in a specific and proactive manner about whether they hold the sanitary operating authorization for the provision of funeral services and the approval of the local council.
